In these Conditions:
Agreement is an agreement between you and Passionfoods online to supply goods that consists of the order and these conditions;
Conditions are these conditions, and any agreed written variations;
1. Your Agreement with Passionfoods:
By using this site and/or ordering form, you agree and accept our terms & conditions of use. If you do not agree with our terms and conditions, please do not use this site and/or our service.
2. Payment Terms
No order will be delivered without payment. Our online payment system doesn’t allow non payments and orders will not be processed.
Online Payment by Credit Card: You may pay for the goods at the time you place the order by providing your credit card details on the online web site and we will process your payment using your credit card (MasterCard, Visa, and American Express). The payment will be processed as we prepare the order for delivery, which in most cases will be the day of delivery but may be the day prior to delivery. If your credit card is declined by your financial institution, we will not be able to guarantee delivery on the date or in the delivery window you selected and may contact you to make alternative delivery and payment arrangements. If you are not at the Delivery Address or organize a redelivery, the payment will be processed on the original date of the order. If the order is cancelled or refunded, the credit will be processed on the next business day.
3. Minimum Order
The minimum order is $55 all orders less than this amount will not be processed.
4. Delivery Charges
Delivery charges are listed on the delivery information section.

Product List is the list of goods displayed on the Passionfoods online web site, as amended from time to time; and
Delivery Fee is the fee payable to Passionfoods in respect of delivery of the goods and handling costs associated with processing your order, as advised by Passionfoods from time to time
5. Refund Policy
We have a 100% satisfaction guarantee policy. If you are not happy with a particular item let us know and we will refund or replace it in your next order.
Making a claim: If you wish to make a claim for a replacement product, refund or credit because:
1.you believe that an item, which was ordered by you and which was in stock, has not been provided; or
2.you are not satisfied with the quality of the goods you have purchased
ALL REFUNDS ARE ONLY APPLICABLE IF YOU INFORM US BY 6PM THE DAY YOUR ORDER IS DELIVERED.
Courier deliveries: Whilst the very best care is taken with produce boxes when delivered by our external courier services, no responsibility can be taken by for any produce that arrives slightly bruised or damaged during the delivery process.
6. Delivery of the Goods
In order to purchase Fresh produce from the delivery address which you nominate it will need to be within a suburb where we provide delivery services. All grocery orders can be shipped anywhere in Australia via Australian Post. Please ensure that your delivery address and suburb are correct by confirming these with us at the time of ordering or by checking your order confirmation.
Authorised receipt of Goods: Anyone at the Delivery Address (or upon collection) who receives the goods shall be presumed to be authorised to receive the goods.
Delivery times and arrival of your order will depend on your area. In the event of unforeseen circumstances, changes may be made to the delivery schedule. Any delivery times provided by staff are approximate times and cannot necessarily be relied upon.
If nobody is home to receive the Goods and no delivery instructions have been made, the order shall be left at the front door or in the most suitable, safest place available.
Delivery Address is the address to which the goods are to be delivered as stated on the Order;
Goods are goods described in an order, and includes packaging;
Intellectual Property Rights includes all rights in respect of copyright, trademarks, patents, designs, protection of confidential information and circuit layouts, whether arising under statute or otherwise;
Order is an order by you to purchase goods from Passionfoods;
7. RISK AND TITLE IN THE GOODS
Risk and title of the goods passes to you upon delivery and payment of the goods to the delivered address.
8. Unattended deliveries
We cannot be held responsible for any unforeseen damage or theft to your order when left in a designated area specified by you. We don't recommend leaving your delivery out in the elements for long, and suggest you unpack and store goods correctly as soon as possible.
9. Total Price of Goods
Purchase price: The purchase price of the goods as shown on the Product List is the purchase price which is applicable at the time you view it.
Total price of Goods: Goods in Your Order are charged at the purchase price applicable at the time you submit your order and as shown on the order confirmation, except:
1.If goods are out of stock, in which case you will not be charged for that good;
2.If you have given instruction that you will accept a substitute good, in which case the substitute goods will be charged at the lower of the original or the substitute price at the time the substitute goods are processed and scanned for your order; and
3.If you have ordered goods that is priced per kilo, in which case the actual purchase price for the good is calculated by us after the good has been weighed and the purchase price charged will be the lower of the purchase price per kilo applicable at the time you place your order and the purchase price per kilo applicable at the time your order is processed.
Tax invoice: Upon delivery of the goods, we will provide you with a tax invoice specifying the total price for the goods, including credits applied and the Delivery Fee.
10. Packaging & Labeling of goods
Our aim is to include on the shopping list up-to-date information and pictures of the goods. At times, the picture of the goods on the Product List may differ from the goods actually supplied to you .Passionfoods does not warrant the accuracy of the information contained in the Product List and recommends that you read the labels on Goods carefully before consuming the goods
11. Limitation of Liability
Our maximum liability to you for products purchased from our website shall be limited to the refund of the purchase price you have paid for the products. We will not be liable for any property damage, personal injury, loss of use, interruptions of business, loss of profits, or other consequential, indirect, incidental, punitive or special damages, however caused, whether for breach of warranty, contract, tort (including negligence), strict liability or otherwise except which it is unlawful to exclude.
12. Disclaimer
We have made every effort to ensure that the information on our website is correct at the time we put it there. While we apologize if any errors have been made, we do not guarantee the accuracy of the information on these pages and all users do so at their own risk. All images used on this site are representations for your information only and are not necessarily true images of that product.
13. LAWS
The laws of Victoria govern this Agreement.
